Kishun Inc. (hereinafter, “the Company”) has established and will comply with the following policy (hereinafter, “this Policy”) in regard to the handling of personal information of our customers (including applicants when the Company holds a contest), business partners, job applicants, employees and other related parties (hereinafter, “Customers, etc.”) in the Company’s business activities and the services provided by the Company (hereinafter, “the Services”).

Article 1: Definitions

“Personal information” refers to information that is related to a living individual and that falls under any of the following items.
(1) Information that can be used to identify a specific individual based on the name, date of birth, and other descriptions contained in the information (referring to any matters that are listed or recorded in documents, drawings, or electromagnetic records [referring to records made in an electromagnetic format {electronic, magnetic, or other formats not recognizable by the senses}]) or expressed using voice, actions, or other methods (excluding individual identification codes), including information that can be used to identify a specific individual, either on its own or easily collated with other information to identify a specific individual.
(2) Information that includes an individual identification code (the definition of an individual identification code is as set forth in Article 2, paragraph 2 of the Act on the Protection of Personal Information).

Article 2 Scope of Application

1. This Policy applies when using the Services.
2. If the Company establishes separate terms of use for the Services (hereinafter, “the Terms of Use”) from this Policy and specifies the handling of personal information of Customers, etc., both this Policy and the Terms of Use will apply when using the Services. In this case, if there is a conflict between this Policy and the Terms of Use, the Terms of Use will take precedence.
3. The collection of personal information by other businesses on linked websites related to the Services is not within the scope of this Policy.

Article 3 Acquisition of Personal Information

The Company will acquire personal information in a proper manner and will not acquire personal information through fraudulent or illegal means.
The Company will acquire personal information to the extent necessary for the Company to provide the Services through methods in which information is provided by Customers, etc., methods in which information is provided by other services when a link to other services is approved by Customers, etc., when using the Services, and methods in which the Company collects information when Customers, etc., use the Services.
The Company will acquire personal information in a proper manner and will not acquire personal information through fraudulent or illegal means, etc.
Furthermore, Customers, etc., will not provide the Company with personal information acquired through fraudulent or illegal means, etc.

Article 4 Purpose of Use

1. The Company will use the personal information acquired as specified in each item for the purposes set forth below, and will handle the personal information only within the extent necessary to achieve those purposes. If it becomes necessary to change the purpose of use, the Company will make said change to a degree that is reasonably considered to be related to the previous purpose of use, and will notify or publicize the changed purpose of use to our Customers, etc.

(1) Personal information related to the Company’s customers
・To verify the identity of a person and prevent fraudulent use of the Services
・To provide the Services (including contact, delivery and receipt of handled materials and products, and billing for handled products, etc.), to create statistical data regarding the use of the Services, and to improve the Services
・To conduct surveys regarding the Services currently provided or those for which the Company is considering provision in the future
・To provide information and conduct sales activities regarding the Company’s handled products, stores, and services
・To provide information on the Company’s latest news, exhibitions, seminars, and events
・To respond to customer inquiries
・To provide important information related to the Services, such as information on new services
・To formulate and provide new plans for the Services in the future
・To use for other purposes that are not mentioned above and specifically stated when acquiring the personal information of customers individually
・To use for purposes related to the purposes listed in the above items

(2) Personal information related to the Company’s business partners
・To contact partners in regard to the Company’s business, to execute contracts, and to hold business consultation
・To manage the information of business partners

(3) Personal information related to parties who have contacted the Company
・To respond to inquiries and engage in other necessary contact

(4) Personal information related to applicants in the Company’s hiring process
・To be used in the Company’s hiring process, etc.

(5) Personal information related to the Company’s employees
・To be used in personnel management, etc., for the Company’s employees

2. The Company will not use personal information in a manner that may encourage or induce illegal or fraudulent behavior.

Article 5 Provision of Personal Data to Third Parties

The Company will not provide personal data that is contained in the personal information handled by the Company to third parties without the consent of the individual Customer, etc. However, this does not apply in any of the following items:

(1) When the Customer, etc., has given prior consent
(2) When required by law
(3) When necessary for the protection of a person’s life, body, or property, and it is difficult to obtain the consent of the Customer, etc.
(4) When particularly necessary for the improvement of public health or the promotion of healthy child development, and it is difficult to obtain the consent of the Customer, etc.
(5) When necessary to cooperate with a national institution, local government, or a party commissioned by them in carrying out duties prescribed by law, and obtaining the consent of the Customer, etc., may interfere with the performance of such duties
(6) When the Company’s business, including the provision of personal information, is succeeded due to a merger, company split, business transfer, or other reason

Article 6 Entrustment of Personal Data Handling

The Company may entrust all or part of the personal data obtained from Customers, etc., to the extent necessary to achieve the purpose of use of the Services. In this case, the Company will select a party that is deemed to engage in appropriate handling of personal data when considering the safety management measures of the party to which data is entrusted. The Company will properly stipulate in the entrustment contract the matters related to safe management, confidentiality, conditions of re-entrustment and other matters related to the handling of personal data, will create a system for the appropriate management of personal data, and will engage in necessary and appropriate supervision of the party to which data is entrusted.

Article 7 Joint Use of Personal Data

In providing the Services, the Company may jointly use personal data from the personal information of Customers, etc., with business partners who work with us. In such cases, the Company will jointly use the personal data after notifying or announcing in advance to Customers, etc., matters required by law, such as the items of personal data to be jointly used, the purpose of use, the name of the business partner, the type of information, and the name of the person responsible for managing the personal data.

Article 8 Use of Statistical Data

The Company may create statistical data based on personal information obtained from Customers, etc., which has been processed so that individuals cannot be identified. The Company may use such statistical data that does not identify individuals without any restrictions.

Article 9 Safe Management Measures

In accordance with the Act on the Protection of Personal Information and the guidelines established by the Personal Information Protection Commission, the Company has established a Basic Policy on Safe Management and Rules for the Handling of Personal Data, and implements organizational safety management measures, personnel safety management measures, physical safety management measures, technical safety management measures, and safety management measures related to understanding the external environment. Article 10 Disclosure, Correction, and Suspension of Use, etc. of Personal Data

1. If a Customer, etc., wants the Company to disclose personal information and records of third-party provision that cannot be confirmed through the Services, the Customer, etc., may request disclosure in accordance with procedures separately specified by the Company, except in the cases specified in each of the following items. Regarding the notification of the purpose of use, disclosure of personal information, and disclosure of records of third-party provision, please note that the Company may charge a handling fee (2,000 yen per case. However, if the Company determines that the content of the disclosure request will result in a large amount of work, the Company will contact the Customer, etc., with an estimate in advance.), depending on the method of disclosure requested by the Customer, etc. If the requested disclosure method requires a large amount of cost or is otherwise difficult, the Company will perform disclosure in written form. Please note that if the handling fee specified in this paragraph is not paid, the Company will not disclose personal information or notify the purpose of use as specified in this article, and will not refund the handling fee even if it is not possible to disclose personal information, notify the purpose of use, or disclose records of third-party provision.

(1) When disclosure is likely to harm the life, body, property, or other rights and interests of Customers, etc., or third parties
(2) When disclosure is likely to seriously interfere with the proper performance of the Company’s business
(3) When disclosure would violate laws and regulations
(4) When the Company cannot confirm the identity of the Customer, etc., that is requesting disclosure

2. If a Customer, etc., requests the Company to suspend the use of their personal data, erase the data, or suspend the provision of the data to a third party (hereinafter, “Suspension of Use, etc.”), the Company will confirm the identity of the Customer, etc., making the request and then conduct any necessary investigation without delay. Based on the investigation results, the Company will correct the content of the personal data or suspend its use, and then notify the Customer, etc., of the actions taken. However, if Suspension of Use, etc., of personal information would involve a large amount of cost or the Suspension of Use, etc., is otherwise difficult, and if alternative measures necessary to protect the rights and interests of the Customer, etc., can be taken, the Company will take these alternative measures. Furthermore, if the Company implements Suspension of Use, etc., for all or part of personal information, the Company may not be able to provide the requested services.

(1) When the personal information is handled beyond the scope of the purpose of use
(2) When the personal information was obtained by illegal means
(3) When the personal information is used in a manner that is likely to encourage or induce illegal or fraudulent action
(4) When personal information is provided to a third party in violation of Article 27, paragraph (1) or Article 28 of the Act on the Protection of Personal Information in regard to the suspension of third-party provision
(5) When the Company no longer needs to use the personal information
(6) When there is or is likely to be a leak, loss, or damage (hereinafter, “Leakage, etc.”) of personal information that includes sensitive personal information
(7) When there is or is likely to be Leakage, etc. of personal information that may cause financial damage due to fraudulent use
(8) When there is or is likely to be Leakage, etc. of personal information that may have been carried out for fraudulent purposes
(9) When there is or is likely to be Leakage, etc., where the number of individuals related to the personal information exceeds one thousand
(10) When there is a risk of harming the rights or legitimate interests of Customers, etc., due to the handling of the personal information

3. When making a request per any of the preceding sections, please send the following information and other information and materials as specified by the Company to the contact desk.

i) Name, address, telephone number, and email address
ii) Details of the request, background, and supporting documents
iii) Copy of identity verification documents (The following documents will be confirmed.)
(1)Copy of a photo ID issued by a government agency, such as a driver’s license, passport, residence card, special permanent resident certificate, or My Number Card (do not send the side of the card that lists your individual number)... 1 copy

4. If the Company is not obligated to comply with the requests under sections 1 and 2 of this Article in accordance with the Act on the Protection of Personal Information or other laws and regulations, the provisions of sections 1 and 2 of this Article will not apply.

Article 11 Informative Data

1. The Company may obtain information on attributes that do not constitute personal information by themselves, such as cookies, IP address information, and device identification numbers (hereinafter, “Informative Data”) from Customers, etc., or third parties. However, when Informative Data is used in conjunction with personal information, the informative data will also be treated as personal information.

2.2. The Services may use a program provided by an advertising distributor to conduct behaviorally targeted advertising (an advertising method that delivers advertisements based on the interests of Customers, etc., based on website browsing information, etc.) on specific websites. In that case, cookies, etc. will be used to collect website visit history information of Customers, etc. (however, these cookies do not include any information that can identify or distinguish individuals). Advertising distributors use such cookies, etc., to deliver advertisements based on information on past website access. If you wish to disable these advertisements, please access the opt-out page of the advertising distributor and disable the use of cookies, etc. However, in that case, you may not be able to use some of the functions of the service.

Article 12 Changes to this Policy

1.1. The Company may change this Policy at any time. In the event of significant changes, the Company will announce the changes via the Services.
